1. Agreement
By using this website or completing a booking, you agree to these Terms and Conditions, our Booking and Refund Policy, Payment Policy, Privacy Policy and Cookie Policy.
2. Our service
Diani Excursions Office is a local reservation agency on Kenya’s South Coast. We connect travelers with KWS-licensed boat captains and verified local guides for Diani marine park trips, water sports, cultural activities and airport transfers. Captains, guides and drivers operate under applicable Kenyan marine, park and road requirements.
We are not a beach broker. Listed package rates are published on this site so you can book without negotiating on the sand.
3. Guest responsibilities
- Provide accurate booking information and a reachable phone or WhatsApp number.
- Arrive on time at the agreed meeting point with valid identification where required for park entry or transfers.
- Follow all safety instructions from the captain, jet ski operator, guide or driver.
- Pay KWS conservation tickets at the Kisite Mpunguti Marine Park gate when your trip enters protected waters, unless we confirm otherwise in writing.
- Supervise children at all times on shore, during boarding, on the water and during land tours.
- Wear suitable clothing and footwear for marine or walking activities, and use supplied life jackets as instructed.
4. Packages, wildlife and itineraries
Marketing descriptions, photos and duration labels describe typical Diani experiences. They do not guarantee specific wildlife sightings, identical sea conditions, exact clock times or an unchanged market or kitchen itinerary on every date.
Jet ski hire is subject to the operator’s safety briefing, sea conditions and guest ability. Airport transfers are subject to traffic, roadworks and the guest being ready at the agreed time.
5. Payments
Online payments are processed by Pesapal using M-Pesa or card. Card data is handled by the payment provider. You pay the listed package amount shown before checkout. See also our Payment Policy.
6. Cancellations and refunds
Cancellation windows, weather rescheduling and refund eligibility are set out in the Booking and Refund Policy. Those rules form part of these terms.
7. Limitation of liability
Marine excursions, snorkeling, jet skiing, dhow sailing and road transfers involve inherent risks. To the fullest extent permitted by Kenyan law, we are not liable for loss of personal property, injury arising from failure to follow instructions, wildlife not appearing, weather-related changes, traffic delays, or consequential losses such as missed flights or hotel nights.
Our total liability related to a booking is limited to the amount you paid to us for that package, except where Kenyan law requires otherwise.
8. Website use
You may not misuse the site, attempt unauthorised access, submit abusive content, or use automated tools that harm service availability. Content on this site is for booking and information purposes and may be updated without prior notice.
9. Governing law
These terms are governed by the laws of Kenya. Disputes will first be addressed through direct contact with our team. If unresolved, Kenyan courts have jurisdiction.
